You will join a dynamic global legal team working on a variety of legal issues across the entire company. You will be required to leverage your expertise, good judgment, and strong business sense to assess and mitigate legal risk - balancing contract negotiation with providing clear, pragmatic advice across a wide range of matters.
You will be challenged to look at the big picture to find innovative ways and solutions to assist the business in a fast-paced, growth-focused environment. With the ability to understand not just what the law says, but also industry and enforcement trends, you'll help TWE see around corners to prepare for upcoming regulatory changes and influence how the business responds to those changes.
About the role
Reporting to a regional Head of Legal, TWE is seeking a commercially astute lawyer with experience in managing a high volume of commercial transactions. You will help TWE continue its growth and success by supporting our procurement, sales, marketing, corporate and supply teams across the ANZ region, where the majority of work will be. You will also lean in to support our EMEA team, and so experience working across borders will be helpful.
You will:
+ Draft, review, negotiate and provide advice on commercial contracts and documents for the ANZ and EMEA regions.
+ Deliver clear, effective and practical legal advice on a broad range of legal matters and to a broad range of business functions.
+ Be adept in making sensible legal risk assessments which consider practical solutions to mitigate legal risk while keeping business priorities at the forefront.
+ Effectively collaborate with regional and global colleagues to (i) provide globally aligned legal advice that appropriately balances local and global perspectives and needs; and (ii) participate in global workstreams.
+ Review and advise on a diverse range of marketing and promotional activities, partnerships and new product development and innovation initiatives.
+ Provide advice concerning ongoing compliance matters and assist with litigation and disputes as needed.

# Major Responsibilities:
+ Provide leadership on legal and commercial issues relating to prospects and projects in the Asia Pacific Region, including:

About the Role
The Legal Counsel – Employment Relations (Maternity Leave Cover) will partner with business units and P&C Business Partners to provide specialist employment relations advice to our operational and corporate office business leaders as required and take full ownership and accountability for managing cases end to end, in conjunction with P&C and divisional business leaders.
Key Responsibilities
Employment Relations Advice
- Provide advice and guidance to the P&C Team, line and senior management on a range of ER and IR matters such as: industrial instruments, employment arrangements, performance management, misconduct, personal illness, discrimination, sexual harassment, victimisation and bullying.
- Support employees and management to settle employee disputes and workplace grievances by advising on and or conducting internal investigations or early resolution meetings.
- Support the resolution of individual workplace relations issues through advice on workplace policies of the Group and related employment and legal obligations.
- Provide advice and expertise on all relevant industrial relations matters and act as the escalation point for all serious and complex employee and/or industrial disputes.
- Drafting and advising on employment contracts (within the Dayforce system)- from appointment through to disciplinary processes, formal warnings and terminations (templates available).
- Participate, defend and manage FWC conciliations/mediations including applications for unfair dismissal and adverse action.
- Participate, defend and manage discrimination complaints made to the Australian Human Rights Commission and State Anti-Discrimination Bodies.
- Drafting deeds of release and settlement agreements.
Policy Development
- Assist the Senior Leadership team in implementing a strategic and consistent Employment Relations approach across the group through consultation with the Director of P&C.
- Review and maintain IR policies and procedures (as required) to ensure compliance with relevant legislation changes.
Reporting
- Prepare board reports and other reports on relevant matters as directed and required.
Provide Support
- Lead and coach P&C Business Partners and business leaders to manage their ER matters from strategy to execution.
- Communicate complex information or concepts to leaders in non-technical terms.
- Establish and maintain strategic partnerships with internal and external stakeholders.
Skills & Experience
The successful applicant will be degree qualified in employment law with experience working in a commercial environment. Previous experience in the hospitality and/or entertainment sector would be highly regarded but not vital.
Experience in the following areas is essential:
- Demonstrated knowledge of Australian Employment Law, Fair Work Act and ER procedures and processes.
- Experience in New Zealand employment law will be well- regarded.

- Approachable and readily available to provide advice for day to day queries and provide practical solutions especially to the P&C Team members.
- Experience in case management, investigations, compiling reports and recommendations.
